These terms cover your use of https://peaksolutions.tech (the "site"), which is run by Apex Software, LLC, doing business as Peak Solutions ("we", "us"), a Kentucky limited liability company. By using the site you agree to these terms. If you don't agree, please don't use it.
What these terms cover
These terms apply to the website only. Any design, development, hosting or support work we do for you is covered by a separate written agreement or statement of work. If that agreement conflicts with these terms, the agreement wins.
Information on the site
We try to keep everything here accurate and current, but descriptions of our services, timelines and prices are general information, not an offer. A price or timeline only becomes binding when it's in a signed agreement or written quote.
Using the site
You're welcome to browse, share links and get in touch. You agree not to:
- break the law or anyone else's rights through the site;
- try to get unauthorised access to the site, its servers or any connected system;
- send spam, malware, or automated submissions through the contact form;
- scrape or copy the site in bulk, or interfere with how it works for other people;
- pretend to be someone else when contacting us.
Intellectual property
The site's design, text, code, graphics and the Peak Solutions name and logo belong to us or our licensors. You may not reuse them without our written permission, apart from normal browsing and sharing. Names, logos and screenshots of client and partner projects on our work page belong to their respective owners and appear with permission or as a factual description of our work.
What you send us
When you contact us, please don't include passwords, payment details or confidential information. If you need to share something confidential before a project starts, ask and we'll sign a non-disclosure agreement first. We handle what you send as described in our privacy policy.
Links to other sites
The site links to websites we don't control, including sites we've built or support for clients. We're not responsible for their content, availability or privacy practices.
Disclaimer
The site is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, about the site, including warranties of merchantability, fitness for a particular purpose, or that it will be uninterrupted or free of errors.
Limitation of liability
To the extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred US dollars (US$100). This section doesn't limit liability that can't be limited by law.
Indemnity
If you misuse the site or break these terms and a third party makes a claim against us because of it, you agree to cover our reasonable costs, including legal fees.
Governing law
These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law rules. Any dispute will be handled in the state courts of Scott County, Kentucky, or the federal courts for the Eastern District of Kentucky, and you agree to their jurisdiction. Before going to court, we both agree to try to resolve the dispute informally by contacting each other for at least 30 days. Nothing here takes away consumer rights you have under the law where you live.
Changes
We may update these terms from time to time. The date at the top shows when they last changed, and the version on the site when you use it is the one that applies.
General
If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a term right away doesn't mean we've waived it. These terms, together with our privacy and cookie policies, are the whole agreement between you and us about the site.
